New York courts have a very limited set of circumstances under which they will enforce the rights of grandparents to maintain a relationship with grandchildren.
The state applies a two part test when considering a grandparent’s petition for visitation.
First, the court wants to evaluate the request in terms of the best interest of the child. Second, the court will evaluate the condition of your relationship with your grandchild.
Courts are most sympathetic to the rights of grandparents when their child, the parent of the grandchildren in question, has died and the other parent limits the grandparents’ access.
