A separation agreement covers the same territory that a divorce settlement does, including child custody and support, division of property, financial matters, spousal maintenance, and other relevant issues. In that sense, they are the same, but a separation agreement alone does not make you legally divorced.
A separation agreement can become a divorce settlement. If you have been legally separated for a year and your separation agreement has been satisfactory to you, you may ask the court for what is known as a Conversion Divorce, essentially converting the separation agreement to a divorce settlement.
