New York recognizes two types of custody, legal and physical.
If a parent has sole legal custody of a child, that parent is responsible for making major decisions about the child, such as choices about medical and surgical procedures, where the child goes to school, what religious instruction (if any) your child receives, and more.
Physical custody indicates which parent is the day-to-day caretaker for the child, and the parent that the child lives with.
The term “custodial parent” applies to the parent who has physical custody.
